CNN —The Supreme Court on Monday declined to review an appeal from a group of parents who claimed their suburban Washington-area school district was hiding transgender support plans involving their children. It’s the latest in a series of cases where the high court has dodged the issue of transgender rights at school – often leaving in place lower court rulings that sided with trans students. The appeals court said that the parents had not established that they were injured in a way that allowed them to sue. Three years ago, the Supreme Court declined to take up an appeal from a Virginia school district about whether schools may ban transgender students from using a bathroom that reflects their gender identity. Last year, the court denied West Virginia’s request to let it enforce a state law that bans transgender women and girls from participating on public school sports teams.

CNN —A federal judge has granted a motion to reopen the sentencing in the case against David DePape, the man convicted of the 2022 attack on House Speaker Emerita Nancy Pelosi’s husband, Paul, because he did not get a chance to speak during his sentencing hearing Friday. The judge will reopen the sentencing portion of the case on May 28 at 9:30 a.m. Nonetheless, it was the Court’s responsibility to personally ask Mr. DePape if he wanted to speak. Testifying in his own defense, DePape recalled that he was looking for Nancy Pelosi and that her husband was not on his list of targets. A state case against DePape that includes charges of attempted murder, burglary and assault is expected to go to trial this summer.

Congress created the bureau in 2010 to protect consumers from financial scams. The payday lending groups sued over a 2017 bureau rule that prohibited attempts to withdraw payments from accounts after two consecutive tries failed due to insufficient funds. Because of that, the conservative appeals court tossed the payday lending rule. The Biden administration appealed to the Supreme Court in 2022. Jean Carroll have asked a federal appeals court to expedite Donald Trump’s appeal of the verdict in their first trial in which a jury awarded Carroll $5 million in damages after finding Trump liable for defamation and battery in May 2023. The motion with the 2nd US Circuit Court of Appeals filed Tuesday cites Trump’s numerous attempts to delay both trials with Carroll as a signal that he’s likely to drag out the appeal. The jury in the second trial held in January determined Trump should pay Carroll $83.3 million in damages for defaming her. Her lawyers also asked the appeals court to consider the author’s progressing age. Carroll is an 80-year-old woman who has struggled mightily to obtain justice for almost five years,” the filing says.

Wilmington, Delaware CNN —The federal judge overseeing Hunter Biden’s gun case in Delaware refused on Tuesday to delay the June 3 trial date despite pleas from lawyers for the president’s son who said they would not be prepared in time. “I trust everyone can get done what needs to be done,” US District Judge Maryellen Noreika said during a status conference in Wilmington. Hunter Biden’s lawyer Abbe Lowell argued the defense team would not be able to accomplish all that needs to be done in under three weeks. “I don’t need to be your scheduling secretary,” Noreika said, telling Lowell to work out new filing deadlines with the prosecution ahead of the trial date. CNN —The Georgia Court of Appeals will consider an effort by Donald Trump and his co-defendants to disqualify District Attorney Fani Willis from the 2020 election subversion case. In a brief order Wednesday, the court said it will hear the appeal from Trump and others challenging the ruling from Judge Scott McAfee that allowed Willis to remain on the case. No trial date has been set in the sprawling election subversion conspiracy case against Trump, and the decision to consider the appeal is another sign that pre-trial efforts to delay a trial are succeeding. Tuesday, a federal judge in Florida indefinitely postponed Trump’s trial on mishandling classified documents at his Mar-a-Lago estate. Willis testified that she paid Wade back for the expenses in cash.

The Georgia Court of Appeals will hear an appeal of a ruling that allowed Fani T. Willis, the district attorney in Fulton County, to continue leading the prosecution of former President Donald J. Trump on charges related to election interference, the court announced on Wednesday. The decision to hear the appeal, handed down by a three-judge panel, is likely to further delay the Georgia criminal case against Mr. Trump and 14 of his allies, making it less likely that the case will go to trial before the November election.
